Tern Health
Placeholders to fill in before publishing are marked in [BRACKETS]: your privacy-contact email and the effective date (and optionally a mailing address). Everything else describes how Tern Health actually handles data today. Have a privacy attorney review this before you scale — you handle health-adjacent information, and state laws (notably California's CMIA and CCPA/CPRA) and the FTC's Health Breach Notification Rule may apply to you.
Tern Health is a service operated by Agentic Swell LLC ("Agentic Swell," "we," "us"), available at tern.health. This policy explains what we collect, why, who we share it with, how long we keep it, and the choices you have. It covers Tern Health only. We wrote it in plain language on purpose.
We do not sell your personal information. We do not show ads, and we do not share your information with advertisers or data brokers.
Information you give us through the survey. To build your personalized report, we ask about your situation — for example your state, your current or upcoming coverage, the month and year you turn 65 or your coverage-end date, how often you use healthcare, how important keeping specific doctors is, whether you take prescriptions (including brand-name drugs), whether your income is above a certain threshold, and any dental, vision, or hearing needs. Some of this is health-adjacent information. We collect it only to generate your report.
Your email address. If you purchase a report, we use your email to send a receipt and give you access to your report. If you join the waitlist for a guide we haven't built yet, we collect your email to notify you when it's ready.
Payment information. Payments are processed by Stripe. We do not see or store your full card number — Stripe handles that. We retain a record that a payment was made (such as a Stripe identifier and your email) to fulfill your order and for accounting.
Basic technical information. We generate a session identifier to tie your survey answers to your report, and we record timestamps. Our hosting and infrastructure providers may log standard technical data (such as IP address and browser type) for security and reliability.
We do not use your information to advertise to you, and we do not sell it.
We use a small number of trusted service providers ("sub-processors") to run Tern. They are permitted to use your information only to provide their service to us:
We may also disclose information if required by law, to protect our rights or safety or those of others, or in connection with a business transfer (such as a merger or acquisition), in which case we will require that this policy continue to apply.
Agentic Swell LLC operates other, unrelated services. We do not use your Tern Health information for those services, and we do not combine it with data from them.
You can ask us to delete your information sooner — see "Your choices" below.
We restrict access to your data so it can only be read or written by our secured server processes, not by the public. Data is encrypted in transit. No system is perfectly secure, but we take reasonable measures to protect your information, and we limit how long we hold the most sensitive parts of it.

If you are a California resident, the CCPA/CPRA gives you rights to know what personal information we collect, to request its deletion, to correct it, and to not have it sold or shared for cross-context behavioral advertising — which we don't do. We will not discriminate against you for exercising these rights. To exercise them, email us at the address above.
We will respond to your request within the time required by applicable law.
Tern is educational, not advice. Tern Health provides general educational information to help you navigate Medicare decisions. It is not medical, legal, insurance, or financial advice, and using Tern does not create any professional relationship.
We are not affiliated with the U.S. government. Tern Health is a private company. We are not Medicare, the Centers for Medicare & Medicaid Services (CMS), the Social Security Administration, or any government agency, and we are not endorsed by them.
Not for children. Tern is intended for adults and is not directed to anyone under 18. We do not knowingly collect information from children.
We may update this policy from time to time. When we do, we will revise the "Last updated" date above, and significant changes will be reflected on this page.
